FTC & Advertising Disclosure Policy

Last Updated: July 2026 · Version 1.0 · Kreative Learners Academy — I.T. Kreative Inc.

This policy explains the disclosure requirements for all affiliates of Kreative Learners Academy. Affiliates must comply with the Federal Trade Commission (FTC) guidelines on endorsements and testimonials (16 CFR Part 255) and all applicable advertising laws. This policy is part of the Affiliate Program Agreement.

1. Overview

The FTC requires that affiliates disclose their material connection to the products they promote. A "material connection" exists when an affiliate earns a commission from purchases made through their links. This connection must be disclosed clearly and conspicuously so that consumers can make informed decisions.

⚠️ Failure to disclose your affiliate relationship is a violation of FTC guidelines and this policy. It may result in account suspension and legal liability.

2. Disclosure Requirements

Every promotional piece that contains an affiliate link must include a disclosure that:

  • Is clear and understandable — Use plain language, not legal jargon
  • Is conspicuous — Placed where consumers will see it before clicking
  • Is not hidden — Not buried in a "more" section, footer, or small print
  • Is timely — Appears before or at the point of the affiliate link
  • Is honest — Accurately describes the affiliate relationship

3. Recommended Disclosures

Use one of the following disclosure statements (or a substantially similar version):

"I may earn a commission if you purchase through this link at no additional cost to you."

"As an affiliate, I earn from qualifying purchases."

"This post contains affiliate links. I may earn a commission if you make a purchase."

"Disclosure: I receive a commission for purchases made through these links."

"#Ad — This contains affiliate links. I earn a commission on qualifying purchases."

4. Instagram Disclosures

For Instagram posts and Stories:

  • Place the disclosure at the beginning of the caption, before "more"
  • Use #ad or #affiliate as a hashtag, but do not rely on it alone
  • For Stories, place the disclosure on the same frame as the affiliate link
  • For Reels, mention the affiliate relationship in the first 3 seconds or in the caption
  • Do not hide the disclosure behind a "Read More" cutoff

5. Facebook Disclosures

For Facebook posts:

  • Place the disclosure at the beginning of the post text
  • Use Facebook's built-in "Branded Content" tool when applicable
  • For videos, include the disclosure in the video itself (first 3 seconds) and in the description
  • For Facebook Stories, overlay the disclosure on the story frame containing the link

6. TikTok Disclosures

For TikTok videos:

  • State the disclosure verbally in the first 3 seconds of the video
  • Include the disclosure in the video caption
  • Use TikTok's "Branded Content" disclosure toggle when available
  • Overlay text on the video stating "Contains affiliate links" or "#ad"
  • For TikTok Stories, place the disclosure on the same frame as the link

7. Pinterest Disclosures

For Pinterest pins:

  • Include the disclosure in the pin description, near the beginning
  • For Idea Pins (video), include the disclosure in the first frame or text overlay
  • Use hashtags like #ad or #affiliate in addition to text disclosure
  • Do not rely on hashtags alone — include a clear text statement

8. Blog Disclosures

For blog posts and articles:

  • Place the disclosure at the top of the article, before any affiliate links
  • Use a visible disclosure box or banner
  • Repeat the disclosure near each affiliate link if the article is long
  • Include a dedicated "Affiliate Disclosure" page linked from the footer
  • Do not place the disclosure only in the footer where readers may not see it

Example blog disclosure box:

"This blog post contains affiliate links. If you click through and make a purchase, I may earn a commission at no additional cost to you. I only recommend products I genuinely believe in."

9. Email Disclosures

For email newsletters and promotional emails:

  • Place the disclosure at the top of the email, above the fold
  • Include it in the preview text where possible
  • Repeat the disclosure near each affiliate link in longer emails
  • Include a full affiliate disclosure at the bottom of every email containing affiliate links

10. Video Descriptions

For YouTube and other video platforms:

  • State the disclosure verbally in the first 30 seconds of the video
  • Include a text disclosure in the video description, near the top
  • Overlay text on the video itself stating "Contains affiliate links"
  • For YouTube, use the "paid promotion" disclosure feature when applicable

11. Livestreams

For live video streams and webinars:

  • State the disclosure verbally at the beginning of the stream
  • Repeat the disclosure periodically throughout the stream
  • Include the disclosure in the stream title or description
  • Pin a comment with the disclosure if the platform supports it
  • For replays/recordings, ensure the verbal disclosure is included

12. Disclosure Placement

The key principle is that the disclosure must be:

  • Before the affiliate link, not after
  • Adjacent to the affiliate link, not separated by other content
  • Visible without scrolling on mobile devices when possible
  • Not hidden behind tabs, accordions, or "read more" expanders

13. Enforcement

The Platform may periodically review affiliate promotional content for disclosure compliance. Affiliates found violating disclosure requirements will be notified and given an opportunity to correct the issue. Repeated or willful violations may result in:

  • Suspension of affiliate account
  • Forfeiture of pending commissions
  • Permanent removal from the Affiliate Program

Affiliates are solely responsible for their compliance with FTC guidelines and all applicable advertising laws. The Platform is not responsible for an affiliate's failure to comply.
