These Terms of Use govern your access to and use of the Kreative Learners Academy platform, operated by I.T. Kreative Inc. By accessing or using our services, you agree to be bound by these terms. Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using Kreative Learners Academy ("the Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not use the Platform.

These terms constitute a legally binding agreement between you and I.T. Kreative Inc. Your continued use of the Platform following any updates to these terms constitutes your acceptance of the revised terms.

2. Platform Description

Kreative Learners Academy is an online learning marketplace that enables qualified instructors to create and publish educational content and allows students to enroll in and access that content. The Platform includes:

  • Online video courses, text lessons, quizzes, and assignments
  • AI-assisted course creation tools
  • Certificates of completion
  • Live coaching and session features (where available)
  • Instructor earning and payout systems

I.T. Kreative Inc. acts as a marketplace and does not independently verify all instructor credentials or guarantee course outcomes.

3. User Accounts

To access most features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

You must be at least 13 years of age to create an account. Users under 18 must have parental or guardian consent. We reserve the right to suspend or terminate accounts that violate these terms.

4. Student Responsibilities

As a student on the Platform, you agree to:

  • Use course content solely for your personal, non-commercial learning
  • Not share, distribute, or resell course access or materials without authorization
  • Not record, download, or reproduce video content in an unauthorized manner
  • Maintain respectful conduct toward instructors and other students
  • Not submit fraudulent reviews or ratings
  • Honor any restrictions placed on course access or enrollment

5. Instructor Responsibilities

Instructors are responsible for all content they create, upload, and publish on the Platform. By becoming an instructor, you agree to our separate Instructor Terms, which are incorporated into these Terms of Use. Key obligations include:

  • Creating original, accurate, and educationally valuable content
  • Owning or having the legal right to use all uploaded materials
  • Maintaining professional standards of conduct
  • Keeping course content up-to-date and accurate

6. Marketplace Rules

Kreative Learners Academy operates as a two-sided marketplace connecting instructors and students. By participating, all users agree:

  • The Platform does not endorse any specific instructor or course
  • Transaction disputes between students and instructors are governed by our Refund Policy
  • The Platform may remove, modify, or restrict content that violates these terms
  • Pricing, availability, and content are subject to change at any time

7. Payments & Transactions

All transactions on the Platform are processed securely through Stripe or other authorized payment providers. By making a purchase, you:

  • Authorize the Platform to charge the stated amount to your payment method
  • Agree that all sales are subject to our Refund Policy
  • Acknowledge that course prices may change at any time
  • Accept that applicable taxes may be added to purchases depending on your location

Instructor payouts are governed by the Instructor Terms and applicable Stripe Connect agreements.

8. Refunds

Our Refund Policy governs all requests for course refunds. Generally, students may request a refund within the eligible window after purchase, subject to usage thresholds. Please refer to our Refund Policy for complete details. I.T. Kreative Inc. reserves the right to deny refund requests that do not meet policy requirements.

9. AI-Assisted Content

The Platform provides AI-powered tools to assist instructors in creating course content. Users acknowledge that:

  • AI-generated content may not always be accurate, complete, or free of errors
  • Instructors remain solely responsible for all published AI-assisted content
  • The Platform does not guarantee the quality or accuracy of AI-generated materials
  • AI tools may be updated, changed, or discontinued at any time

10. Intellectual Property

Instructors retain ownership of their original course content. By publishing on the Platform, instructors grant I.T. Kreative Inc. a worldwide, non-exclusive license to host, display, market, and distribute their content as described in the Instructor Terms.

All Platform branding, software, design, and technology are owned by I.T. Kreative Inc. and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any Platform content without written permission.

11. Copyright Violations

We respect intellectual property rights and expect users to do the same. If you believe that content on the Platform infringes your copyright, please contact us at support@kreativelearnersacademy.com with a valid DMCA takedown notice. We will investigate and take appropriate action, which may include removing the content and suspending the infringing account.

12. Prohibited Conduct

Users are prohibited from:

  • Uploading illegal, harmful, hateful, explicit, or fraudulent content
  • Harassing, threatening, or abusing other users
  • Attempting to gain unauthorized access to Platform systems
  • Using automated tools to scrape, copy, or bulk-download content
  • Impersonating other users or Platform staff
  • Manipulating reviews, ratings, or enrollment metrics
  • Engaging in spam, phishing, or other deceptive practices

13. Account Suspension

I.T. Kreative Inc. reserves the right to suspend, restrict, or permanently terminate accounts that violate these Terms of Use, our Instructor Terms, or any applicable laws. Account termination may result in loss of access to purchased courses, earnings, or other Platform benefits. We will make reasonable efforts to notify users of account actions, but are not obligated to do so in cases of serious violations.

14. Limitation of Liability

To the fullest extent permitted by law, I.T. Kreative Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, but is not limited to, loss of revenue, data, goodwill, or other intangible losses. Our total liability to you for any claims arising under these terms shall not exceed the greater of: (a) the amount you paid to I.T. Kreative Inc. in the 12 months preceding the claim, or (b) $100 USD.

15. Third Party Services

The Platform integrates with third-party services including Stripe for payment processing, Google and Apple for authentication, and various cloud infrastructure providers. Your use of these third-party services is subject to their respective terms of service and privacy policies. I.T. Kreative Inc. is not responsible for the practices or content of third-party services.

16. Changes to Terms

We may update these Terms of Use at any time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we may notify users via email or through a Platform notification. Your continued use of the Platform following any changes constitutes your acceptance of the revised terms.

17. Affiliate Program

Kreative Learners Academy operates an Affiliate Program that allows users to earn commissions by referring new students to courses on the Platform. Participation in the Affiliate Program is optional and is governed by the following legal documents, which are incorporated into and become part of these Terms of Use:

By applying to, participating in, or using the Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by all of the above Affiliate Legal Documents. Participation in the Affiliate Program constitutes acceptance of these documents. Affiliates are required to accept all Affiliate Legal Documents before their affiliate account can be activated.

Affiliates act as independent contractors, not employees, agents, or partners of I.T. Kreative Inc. The Affiliate Program does not create any employment, partnership, or agency relationship. Affiliate commissions are funded entirely from the Platform's share of revenue and do not reduce instructor earnings.

18. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by I.T. Kreative Inc.
